Why?

Nidal Hasan, the Army psychiatrist who went on a murderous shooting rampage that killed 13 and wounded 32 others at Fort Hood last year, is in pretrial motions. During the hearings, a witness, Pfc. Lance Aviles, stated that he recorded some of the bloodshed with his cellphone camera, but

[...] was ordered by an officer to delete both videos, a military court heard Friday.
Under cross examination, Pfc. Lance Aviles told an Article 32 hearing that his noncommissioned officer ordered him to destroy the two videos on Nov. 5, the same day a gunman unleashed a volley of bullets inside a processing center at the Texas Army post.

The footage could have been used as evidence at the military hearing to decide if Maj. Nidal Hasan should stand trial in the shootings. The 40-year-old American-born Muslim has been charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder.

Twenty-nine witnesses over three days have appeared either in a courtroom or by video link. Prosecutors have not said whether they'll seek the death penalty if the case goes to trial.

The name of the non-commissioned officcer is not given for some reason. This order was illegal as it involved the destruction of evidence. There has got to be more to this story. Why wasn't this officer prosecuted? I do not like the implications of this story. Is there still an Army CYA operation in effect?

You bet there is more to this story. And no matter what we speculate, it is probably worse.

Somebody grab a rope.

There is no doubt in my mind that the tentacles that built this web of deception and deceit go all the way to the WH. There must be a general or two that won't let go of this. We need to get rid of Obama and his minions to hear the real story.

This is pretty ugly. I can't imagine it will affect the verdict, but dang, if this was something other than the idiotic decision of an individual, that's some nasty.

"Is there still an Army CYA operation in effect?"

It is entirely possible a low ranking NCO would take it upon himself to issue that order. Some people will get a nickel's worth of authority and act like they've got Fort Knox in their pocket. Been there and have seen many a fool with that particular "tee" shirt.

But having said that, the manner in which the Army brass exhibited PC thinking whenever complaints were made about this asshole are reprehensible and should result in heads rolling. IMO if properly done those heads would come from some pretty high level positions too!

Unfortunately we won't see that. Like any beauracracy the military covers for their incompetent top officers. History shows that quite well, just look at how many generals Lincoln went through before finding Grant, and HE was a misfit!

Kid - It's hard to say one way or another. Was this reported to higher ranking officers? Was any attempt made to recover the video files from the cellphone? Yes, that can be done just like a computer. There are a ton of questions that this conduct engenders.

Admiral - You are absolutely right. History is replete with incompetent commanders and hubris is not limited to high rank. Perhaps we will never know and this reflects poorly on those who serve honorably and those who do not. Suspicion is also applied with a very wide brush.

Sig, quite true, deleted files aren't exactly deleted. Especially with perpendicular hard disk data storage.

Kid - I did major crime scene investigations though not with so many victims. I'd love to read the reports on this one.

Sig, yea, I don't have anything else intelligent to say about this one, but man it Really bothers me eric holders absolute refusal to even acknowledge 'radical' islam exists in these cases full of 'kahlua snackbar' chants. I think some of that spills over here.

There's more. We'll find it, and when we win the government back we will prosecute them for failure to abide by the OATH! Art. 92 works for anything one doesn't have exactly.

Amen CMB6. There must be full accountability for everyone involved right up the chain of command.
